INFORMATION ON THE PROTECTION OF PERSONAL DATA PURSUANT TO ARTICLE 13 OF EU REGULATION NO. 2016/679 ('GDPR')

FIRPLAST S.r.l., with registered office in VIA SIRTORI, 31 - 20838 RENATE BRIANZA (MB), (hereinafter, "Data Controller"), as data controller, pursuant to art. 13 of EU Regulation no. 2016/679 (hereinafter, "GDPR") informs the subjects requesting information on the purposes and methods of processing of their personal data, their scope of communication and dissemination, as well as the nature of their provision.

PURPOSES OF THE PROCESSING

Pursuant to art. 7 of the GDPR, personal data (consisting of name, surname and email) provided by the data subject through the form on the website of the Data Controller, are used in full compliance with the principle of fairness and lawfulness and the provisions of the law, only after the explicit consent of the data subject, to meet the requests of the data subject and for related and instrumental activities.

The data will also be used to send information, messages, newsletters, commercial and promotional communications relating to the activities and services of the Data Controller, through automatic means, such as e-mail, and traditional means, such as telephone contact with operators, in full compliance with the principles of lawfulness and fairness and with the provisions of the law.

METHODS OF PROCESSING


The processing of your personal data is carried out through the operations specified in art. 4, paragraph 2) GDPR and specifically: collection, recording, organization, storage, consultation, processing, modification, selection, extraction, comparison, use, interconnection, blocking, communication, cancellation and destruction of data. Your personal data are subject to processing by means of computer procedures or, in any case, computerized means by internal subjects specifically appointed for this purpose or committed to confidentiality. The data are stored in electronic files with full assurance of the security measures provided by the legislator. The Data Controller will process personal data for no longer than 2 years from the collection of data for marketing purposes.

COMMUNICATION AND DISSEMINATION

Your data may be made accessible for the purposes specified above to employees and collaborators of the Data Controller, in their capacity as persons in charge and/or internal data processors and/or system administrators. The data collected will not be disclosed or disseminated. Without the need for express consent pursuant to art. 6 letters b) and c) of the GDPR, the Data Controller may communicate your data for the above-mentioned purposes to supervisory bodies, judicial authorities, insurance companies for the provision of insurance services, as well as to those subjects to whom such communication is required by law for the fulfilment of the above mentioned purposes. These subjects will process the data in their capacity as autonomous data controllers.

Personal data are stored on servers located in VIALE LOMBARDIA, 16/20 - 20841 CARATE BRIANZA (MB), within the European Union. In any case, it is understood that the Data Controller, where necessary, will have the right to move the servers even outside the EU. In this case, the Data Controller guarantees that the transfer of non-EU data will take place in compliance with the applicable legal provisions, subject to the drawing-up of standard contractual clauses provided by the European Commission.


RIGHTS OF THE DATA SUBJECT

The Data subject has specific rights pursuant to art. 15 of the GDPR, as follows:

– right to obtain confirmation of the existence or non-existence of his/her personal data, even if not yet recorded, and their communication in intelligible form;

– right to know: a) the source of the personal data; b) the purposes and methods of processing; c) the logic applied in the event of processing with the help of electronic means; d) the identity of the data controller, data processors and the representative designated under art. 3, paragraph 1, GDPR; e) the subjects or categories of subjects to whom the personal data may be communicated or who may become aware of them as appointed representative in the territory of the State, managers or agents;

– right to obtain: a) the updating, rectification or integration of data; b) cancellation, transformation into anonymous form or blocking of data processed unlawfully, including data whose retention is unnecessary for the purposes for which they were collected or subsequently processed; c) certification that the operations in letters a) and b) have been notified, as also related to their contents, to those to whom the data were communicated or disseminated, unless this requirement proves impossible or involves a manifestly disproportionate use of means compared to the protected right;

– right to object, in whole or in part, to: a) the processing of his/her personal data, for legitimate reasons, even if pertaining to the purpose of collection; b) the processing of his/her personal data for the purpose of sending advertising materials or direct selling or for carrying out market research or commercial communication, through the use of automated calling systems without the intervention of an operator by e-mail and / or by traditional marketing methods by telephone and / or mail. Note that the right to object of the data subject for purposes of direct marketing through automated means extends to traditional ones and that, in any case, the data subject may exercise the right to object even in part. Consequently, the data subject may choose to receive either traditional or automated communications, or both.

Where applicable, the data subject has also the rights under Articles 16-21 GDPR (right to rectification, right to be forgotten, right to limit processing, right to data portability, right to object), as well as the right to lodge a complaint with the Data Protection Authority.

At any time, you may exercise your rights by sending:

RETENTION TIME


The data will be kept for the time strictly necessary for the above purposes and according to the terms of the law and, in any case, for two years from the first contacts if in the meantime the right to object is not exercised by the data subject, except for the possible establishment of contractual relations with the Data Controller.
With reference to the processing for the purpose of sending commercial and promotional communications of services of the Data Controller and for sending information messages about his/her/its activities, the data will be stored until the data subject exercises his/her right to object through the methods made available periodically for this purpose.

The data subject may object to the processing of personal data for either one sending method or the other.

NATURE OF DATA PROVISION AND CONSENT


The provision of data by the data subject is optional. However, if data are not provided, the data controller will be unable to carry out the processing operations described. It is also required express consent to the use of the data for marketing purposes related to the services offered by the data controller. The communications will be sent through the use of traditional means or automated means pursuant to art. 130, paragraph 1 and 2, of Legislative Decree 196 of 2003. Please, note that the data subject has the possibility to object to such processing, in particular the possibility to specifically object to the sending of communications through traditional methods and/or automated means, by contacting the above e-mail address provided by the data controller. Consent is considered given when ticking the boxes at the bottom of the form.
